1. Finalità e Ambito

1.1 La presente Politica di Uso Accettabile (l'"**AUP**") definisce gli usi **vietati** della piattaforma SaaS di GOCOTECH, dei suoi moduli, degli assistenti AI **Sofia** e **Sara** e di ogni servizio correlato (il "**Servizio**").

1.2 L'AUP si applica a ogni Utente del Servizio e a chiunque acceda al Servizio tramite l'account dell'Utente. L'Utente è responsabile di garantire che i propri collaboratori, incaricati e utenti finali rispettino l'AUP.

1.3 L'AUP integra — e non sostituisce — i Termini, l'Informativa Privacy, il DPA e ogni norma di legge applicabile.

2. Usi Vietati

L'Utente non deve, e non deve consentire o agevolare che terzi possano, utilizzare il Servizio per:

2.1 Attività illecite e dannose

(a) svolgere o promuovere attività **illegali** o in violazione di leggi, regolamenti o ordini di autorità competenti applicabili;
(b) generare, ospitare o diffondere contenuti che sfruttano o danneggiano minori, o materiale di abuso sessuale su minori (CSAM);
(c) promuovere terrorismo, violenza, autolesionismo, traffico di armi, droga o esseri umani, o altre attività gravemente dannose;
(d) generare o diffondere contenuti che incitano all'odio, alla discriminazione o alle molestie nei confronti di persone o gruppi.

2.2 Violazione dei diritti altrui

(a) violare diritti di **proprietà intellettuale o industriale** (copyright, marchi, brevetti, segreti commerciali) di terzi;
(b) violare il diritto alla **riservatezza, alla protezione dei dati personali** o alla reputazione di terzi;
(c) caricare o trattare dati personali senza disporre delle basi giuridiche, dei consensi e dei diritti necessari.

2.3 Integrità e sicurezza della piattaforma

(a) effettuare **reverse engineering**, decompilazione, disassemblaggio o tentativi di ricavare il codice sorgente, l'architettura o i modelli sottostanti della piattaforma o degli assistenti AI, salvo quanto inderogabilmente consentito dalla legge;
(b) **aggirare, disabilitare o manomettere** i controlli di sicurezza, l'autenticazione, l'isolamento multi-tenant, i limiti tecnici, i rate limit o le misure anti-abuso;
(c) **aggirare, falsare o manipolare i limiti, la contabilizzazione o il consumo dei GO-chips**, o tentare di ottenere accesso o capacità non incluse nel piano sottoscritto;
(d) introdurre o diffondere **malware, virus, codice dannoso** o sfruttare vulnerabilità;
(e) effettuare attività di **scanning, penetration test o ricerca di vulnerabilità** senza previa autorizzazione scritta di GOCOTECH;
(f) accedere ad aree, account, dati o sistemi a cui non si è autorizzati.

2.4 Carichi abusivi e disponibilità del Servizio

(a) generare carichi **abusivi, automatizzati o sproporzionati** (flooding, attacchi **DoS/DDoS**) che compromettano le prestazioni o la disponibilità del Servizio per altri;
(b) effettuare **scraping, crawling o estrazione massiva non autorizzata** di dati dalla piattaforma o tramite essa;
(c) utilizzare bot, script o mezzi automatizzati in violazione dei limiti tecnici o per eludere i meccanismi di consumo.

2.5 Uso commerciale improprio

(a) **rivendere, sublicenziare, noleggiare, distribuire o concedere in uso a terzi** il Servizio o i GO-chips senza autorizzazione scritta di GOCOTECH;
(b) utilizzare il Servizio per **costruire, addestrare o sviluppare un prodotto o servizio concorrente**, o per copiare le funzionalità, gli assistenti AI, le interfacce o il know-how di GOCOTECH;
(c) rimuovere, alterare o oscurare avvisi di copyright, marchi o note di proprietà.

2.6 Uso improprio degli assistenti AI (Sofia / Sara)

(a) impiegare Sofia o Sara per generare contenuti **ingannevoli, fraudolenti, diffamatori, osceni, illegali o lesivi**;
(b) generare o diffondere **disinformazione, deepfake ingannevoli, falsa rappresentazione di persone o impersonificazioni** non autorizzate;
(c) inviare **spam**, comunicazioni commerciali non sollecitate o messaggi in violazione delle norme su email/marketing (incluso il GDPR e la normativa ePrivacy);
(d) **utilizzare Sofia o Sara per inviare messaggi ingannevoli, falsi o fuorvianti ai clienti finali dell'Utente** (i clienti del Cliente): ogni comunicazione automatizzata verso i clienti finali deve essere veritiera, non ingannevole, conforme alla legge e, ove previsto, deve segnalare la natura automatizzata/AI dell'interazione;
(e) tentare di indurre l'AI a produrre output vietati ("jailbreak") o ad aggirare i filtri di sicurezza.

2.7 Integrazioni con marketplace e account di terzi

(a) quando si collegano account di terzi o marketplace (es. **eBay, Amazon, Google** e simili), l'Utente deve **rispettare integralmente le policy, i termini d'uso e le regole** di tali marketplace e piattaforme;
(b) è vietato utilizzare il Servizio per pratiche vietate dai marketplace (es. manipolazione di recensioni, listini ingannevoli, violazione delle politiche di pubblicazione, vendita di beni vietati o contraffatti);
(c) l'Utente è responsabile della liceità dei contenuti pubblicati sui marketplace tramite il Servizio e dei consensi necessari per l'uso degli account collegati.

3. Segnalazione di Abusi

3.1 Chiunque rilevi un uso del Servizio in violazione della presente AUP può segnalarlo a **info@gocotech.com**, indicando una descrizione dell'abuso e, ove possibile, gli elementi utili a identificarlo.

3.2 GOCOTECH valuta le segnalazioni in buona fede e può adottare le misure ritenute opportune, nel rispetto della legge e dei diritti delle parti.

4. Conseguenze delle Violazioni

4.1 In caso di violazione (anche sospetta) della presente AUP, GOCOTECH può, a propria ragionevole discrezione e in misura proporzionata alla gravità:

(a) inviare un **avviso** con richiesta di rimuovere il contenuto o cessare la condotta entro un termine;
(b) **rimuovere o disabilitare** l'accesso ai contenuti o alle funzionalità interessate;
(c) **sospendere**, in tutto o in parte, l'account o il Servizio, anche con effetto immediato in caso di rischio grave per la sicurezza, per terzi o di ordine di autorità;
(d) **risolvere** il rapporto per giusta causa nei casi più gravi o di reiterazione;
(e) segnalare alle **autorità competenti** ove richiesto dalla legge.

4.2 Le misure adottate non pregiudicano il diritto di GOCOTECH al risarcimento dei danni e l'applicazione delle clausole di manleva previste dai Termini. Nessun rimborso è dovuto per le sospensioni o risoluzioni dovute a violazione dell'AUP.

5. Modifiche

GOCOTECH può aggiornare la presente AUP secondo le modalità di modifica previste dai Termini. La prosecuzione dell'uso del Servizio dopo l'entrata in vigore delle modifiche ne costituisce accettazione.

**Prevailing language:** in the event of any conflict of interpretation between the Italian and the English version, the **Italian version prevails**. This Policy is an integral part of the Terms of Service ("Terms"). Capitalized terms have the meaning defined in the Terms.

1. Purpose and Scope

1.1 This Acceptable Use Policy (the "**AUP**") defines the **prohibited** uses of GOCOTECH's SaaS platform, its modules, the AI assistants **Sofia** and **Sara**, and any related services (the "**Service**").

1.2 The AUP applies to every User of the Service and to anyone accessing the Service through the User's account. The User is responsible for ensuring that its collaborators, agents and end users comply with the AUP.

1.3 The AUP supplements — and does not replace — the Terms, the Privacy Notice, the DPA and any applicable law.

2. Prohibited Uses

The User must not, and must not allow or enable third parties to, use the Service to:

2.1 Unlawful and harmful activities

(a) carry out or promote **illegal** activities or activities in breach of applicable laws, regulations or orders of competent authorities;
(b) generate, host or distribute content that exploits or harms minors, or child sexual abuse material (CSAM);
(c) promote terrorism, violence, self-harm, trafficking of weapons, drugs or human beings, or other seriously harmful activities;
(d) generate or distribute content inciting hatred, discrimination or harassment against persons or groups.

2.2 Infringement of third-party rights

(a) infringe third-party **intellectual or industrial property** rights (copyright, trademarks, patents, trade secrets);
(b) infringe third parties' rights to **privacy, personal data protection** or reputation;
(c) upload or process personal data without holding the necessary legal bases, consents and rights.

2.3 Platform integrity and security

(a) **reverse engineer**, decompile, disassemble or attempt to derive the source code, architecture or underlying models of the platform or AI assistants, save as mandatorily permitted by law;
(b) **circumvent, disable or tamper with** security controls, authentication, multi-tenant isolation, technical limits, rate limits or anti-abuse measures;
(c) **circumvent, falsify or manipulate the limits, accounting or consumption of GO-chips**, or attempt to obtain access or capacity not included in the subscribed plan;
(d) introduce or distribute **malware, viruses, harmful code** or exploit vulnerabilities;
(e) perform **scanning, penetration testing or vulnerability research** without GOCOTECH's prior written authorization;
(f) access areas, accounts, data or systems one is not authorized to access.

2.4 Abusive loads and Service availability

(a) generate **abusive, automated or disproportionate loads** (flooding, **DoS/DDoS** attacks) that impair the performance or availability of the Service for others;
(b) perform **unauthorized scraping, crawling or mass extraction** of data from or through the platform;
(c) use bots, scripts or automated means in breach of technical limits or to evade consumption mechanisms.

2.5 Improper commercial use

(a) **resell, sublicense, rent, distribute or grant use to third parties** of the Service or GO-chips without GOCOTECH's written authorization;
(b) use the Service to **build, train or develop a competing product or service**, or to copy GOCOTECH's features, AI assistants, interfaces or know-how;
(c) remove, alter or obscure copyright notices, trademarks or proprietary notices.

2.6 Improper use of the AI assistants (Sofia / Sara)

(a) use Sofia or Sara to generate **deceptive, fraudulent, defamatory, obscene, illegal or harmful** content;
(b) generate or distribute **misinformation, deceptive deepfakes, misrepresentation of persons or unauthorized impersonations**;
(c) send **spam**, unsolicited commercial communications or messages in breach of email/marketing rules (including GDPR and ePrivacy);
(d) **use Sofia or Sara to send deceptive, false or misleading messages to the User's end customers** (the Customer's customers): every automated communication to end customers must be truthful, non-deceptive, lawful and, where required, must disclose the automated/AI nature of the interaction;
(e) attempt to induce the AI to produce prohibited outputs ("jailbreak") or to bypass safety filters.

2.7 Integrations with marketplaces and third-party accounts

(a) when connecting third-party accounts or marketplaces (e.g. **eBay, Amazon, Google** and similar), the User must **fully comply with the policies, terms of use and rules** of such marketplaces and platforms;
(b) it is prohibited to use the Service for practices banned by marketplaces (e.g. review manipulation, deceptive listings, breach of listing policies, sale of prohibited or counterfeit goods);
(c) the User is responsible for the lawfulness of content published on marketplaces through the Service and for the consents required to use the connected accounts.

3. Reporting Abuse

3.1 Anyone who detects a use of the Service in breach of this AUP may report it to **info@gocotech.com**, providing a description of the abuse and, where possible, the elements useful to identify it.

3.2 GOCOTECH reviews reports in good faith and may take the measures it deems appropriate, in compliance with the law and the rights of the parties.

4. Consequences of Violations

4.1 In case of a (even suspected) breach of this AUP, GOCOTECH may, at its reasonable discretion and proportionately to the severity:

(a) send a **notice** requesting removal of the content or cessation of the conduct within a deadline;
(b) **remove or disable** access to the affected content or features;
(c) **suspend**, in whole or in part, the account or the Service, including with immediate effect in case of serious risk to security, to third parties, or upon an authority's order;
(d) **terminate** the relationship for cause in the most serious or repeated cases;
(e) report to the **competent authorities** where required by law.

4.2 The measures taken are without prejudice to GOCOTECH's right to damages and to the indemnification clauses set out in the Terms. No refund is due for suspensions or terminations due to an AUP breach.

5. Changes

GOCOTECH may update this AUP in accordance with the amendment procedure set out in the Terms. Material adverse changes follow the notice, non-retroactivity and termination rules stated in the Terms.
